Court Reinstates Injunction Against CTA-BOI Reports Now On Hold…Again…For Now!
In a very interesting game of judicial ping pong, late yesterday the full Fifth Circuit Court of Appeals reinstated a preliminary injunction against the enforcement of the Corporate Transparency Act (CTA) and the Beneficial Ownership Information (BOI) filing requirements, reversing its own three-judge panel ruling from three days earlier.
However, this relief may be short lived as the merits panel of the Court of Appeals will be hearing the government’s appeal of the preliminary injunction issued by the district court on an expedited schedule. Once the merits panel has heard the appeal and reviewed the arguments of both sides, it could decide to lift the preliminary injunction.
As always, we will continue to monitor the case and the government’s responses and will keep you posted.
